Richard presented a paper “Statutory Wills – As a Sword and a Shield” at the Television Education Network 5th Annual Wills and Estates Conference on 21 August 2014.
The following topics were addressed:
- recent case law on statutory wills for minors (which are subject to different requirements under the legislation, distinct from the applications for the Court for the authorisation of the making of a will or codicil on behalf of a person who lacks testamentary capacity);
- developments in practice and procedure, including the application of the ‘core test’ in Queensland, the importance of ensuring that the statutory will is promptly executed, and maintaining the privacy of the proposed testator;
- further developments on statutory will applications for estate planning purposes; and
- other recent developments in case law, that assist in clarifying various aspects of the statutory wills jurisdiction.
